Avalanche Canada (“we”, “us”, “our”) is committed to providing our users (“you”) with exceptional service. Providing this service involves the collection, use and disclosure of some personal information about our users. Protecting this personal information is one of our highest priorities.

This Privacy Policy explains our practices relating to the collection, use, and disclosure of your personal information through our websites www.avalanche.ca and www.foundation.avalanche.ca  (the “Websites”), social media pages and other interactions with you during our provision of any of our services (the "Services"). Please read this Privacy Policy carefully to understand our practices and how we will handle your personal information.

By using our Websites or our Services, you acknowledge and agree to this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Websites or any of our Services.

This Privacy Policy applies in relation to the provision of the Services and in particular to your use of, or engagement with either or both of the following:

Information You Provide to Us Directly

Information Collected Automatically

We refer to this as “log data.” This log data includes information such as your IP address, browser type, operating system, the referring web page, pages visited, limited device information and cookie information. We use this log data to operate our Services, ensure their reliable and robust performance, and help determine the efficacy of our products.

Use and Disclosure of Personal Information

We may use or disclose your personal information to operate and improve the Websites, to deliver the Services, to process your payments for purchases or donations; to process returns or credits; to administer the Websites (including customer-only access sections) and social media pages; to create and maintain your account, to contact you to respond to an inquiry or in connection with a product you have purchased; to send promotional communications; to administer contests or surveys; to contact you regarding policy changes; to enforce this Policy and our Terms and Conditions; to maintain security and regulatory requirements; to engage in related activities, and for other purposes for which you provide your personal information to us.

We do not rent, sell or lease our customer lists to third parties.

We may send your personal information to our service providers and suppliers, and our legal and financial representatives, accountants and auditors (collectively “Receivers”)  to help us provide services to you and to help us complete the above-noted purposes/tasks. All such third parties are made aware of the confidential nature of your personal information. Your personal information will be shared with Receivers on a “need to know” basis only and we limit the information shared to what is needed for the specific task being performed or fulfilled.

Your personal information may also be disclosed to comply with requests from regulators, government entities and official inquiries; to protect and defend our legal rights; to protect the safety and security of other users of the Services; to prevent fraud; to comply with applicable laws; and for other reasonable purposes communicated to you.

We may use or provide advertisers with anonymous (not individual) aggregate information about our users for the purpose of promoting Avalanche Canada and Avalanche Canada Foundation. We may also use such aggregate information to help advertisers reach the kind of audience they want to target. We do not disclose information about identifiable individuals in our promotional content or to our advertisers.

In the event of sale, transfer, merger, reorganization, dissolution, or similar event we may transfer your information to one or more third parties as part of that transaction, including during the negotiation of an actual or contemplated transaction, but we only provide as much information as is needed for the purposes of the transaction. If we sell our organization or merge with another party, you hereby consent to the transfer of your personal information and all information you provide to us, to our successor for the same purposes as set out in this Privacy Policy.

Cookies and Other Technologies

A cookie is a small piece of data that is stored on your computer or mobile device. Like many websites, we use cookies and similar technologies on our Websites to collect additional website usage data and to operate our Websites. Google Analytics uses persistent cookies to track visitor sessions, visitors across multiple sessions, and referral sources to the Websites. This information is used to better understand your interactions with the Websites and to improve our services and content. We use remarketing services to advertise on third-party websites to you after you visit the Websites. We, and our third-party vendors, use cookies to inform, optimize and serve ads based on your past visits to our Websites.

Safeguards

We take reasonable physical, technological and organizational precautions to prevent the loss, misuse, or modification of personal information under our control.

The safety and security of your personal information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Websites, you are responsible for keeping this password confidential. Passwords registered with our Websites are encrypted to ensure protection against unauthorized access to your personal information.

Your consent to our collection, use and disclosure of your personal information for such purposes remains valid after the termination of our relationship with you.

The Websites may contain links to other websites operated by third parties. Please note that this Privacy Policy applies only to the personal information that we collect or receive from third parties with your consent and we cannot be responsible for personal information that third parties may collect, disclose, store and use, including through their websites. In addition, when you provide information to us through a third-party website or platform, the information may also be collected by the third-party website and may be subject to their privacy policy.

Children’s Privacy

Individuals under the age of 13 must not attempt to register and/or submit any personal information to us without parental consent. We do not knowingly collect personal information from any person who is under the age of 13. If it comes to our attention that we have collected personal information from a person under the age of 13 who does not have parental consent, we will delete this information as soon as reasonably possible. Access, Corrections and Deletion

We make commercially reasonable efforts to keep your personal information complete, up-to-date and accurate. Should you wish to access, update, correct or delete your personal information, or express any concerns regarding our use of your personal information, including data submitted to the MIN, please contact our Privacy Officer at the contact information set forth below. We ask that you provide us with the name, address and email address that you previously provided to us, a brief description of under what circumstances you provided your personal information to us, and the purpose of your request. If you are unsure as to whether we are holding any personal information that belongs to you, you may also contact our Privacy Officer for confirmation.

We will make reasonable efforts to respond to your request as soon as practicable, or in any event, in compliance with applicable laws. In order to protect your privacy and security, we may take steps to verify your identity before granting access or making any changes to the personal information that we maintain.

Keep in mind that even after we delete your personal information held by us or by service providers on our behalf, consumers of our API such as search engines and other third parties may still retain copies of your public information, such as your profile information, even after you have deleted the information from our services or deactivated your account. This includes any sharing on social media services.

Anti-Spam

Where applicable, we will seek your express consent to contact you, including by way of commercial electronic messages, which may include email or SMS text messages. You can unsubscribe at any time from receiving commercial electronic messages by following the instructions in the message or by contacting us our Privacy Officer using the information below.

Even if you have opted out of receiving marketing communications from us, please be aware that we may still contact you for other purposes. For example, we may contact you to provide communications you have consented to receive, regarding the services we provide to you, or if you contact us with an inquiry.

Withdrawing Consent

Where you have provided your consent to the collection, use, and transfer of your personal information, you may have the legal right to withdraw your consent under certain circumstances. To withdraw your consent, if applicable, please contact our Privacy Officer using the information below. Please note that if you withdraw your consent, we may not be able to provide you with a particular product or service. We will explain the impact to you at the time to help you with your decision.

Changes to Privacy Policy

We may update this Privacy Policy from time to time for any reason whatsoever. We encourage you to periodically review this Privacy Policy in order to stay informed of how we are protecting your personal information.

Each time this Privacy Policy is amended, the “Updated” date at the beginning of the Privacy Policy will be revised. If we make any material or substantive changes in this Privacy Policy, we will notify you by posting a clear and conspicuous notice of these changes on the Websites and in this Privacy Policy and sending you an email to the last email we have on file.
